Welcome to Betty Kayton Art. By purchasing items from this website, you agree to the terms set out below. Please read them carefully before making a purchase.

1. Entering Into a Contract

1.1 When you place an order on www.bettykayton.art, you are making an offer to buy an item in accordance with these terms.

1.2 A contract is only formed when you receive an order confirmation email from me. Until then, I reserve the right to decline your order.

1.3 I reserve the right to update these terms at any time. The version in effect at the time of your purchase will apply to your order.

2. How to Buy Items

2.1 Browse available artworks or products on the website and add them to your shopping cart.

2.2To complete your purchase, follow the checkout process and provide accurate contact and payment details.

2.3 All prices listed are in USD and include any applicable taxes.

2.4 Shipping is free for all US orders.

2.5 Shipping costs will be added at checkout for all international orders. Please use the Contact Me page to request International shipping costs before making a purchase.

2.6 Payment must be made in full before items are shipped. Accepted payment methods will be shown during checkout.

2.7 Custom orders require a non-refundable 30% deposit upfront and the balance payable once the order is processed. Custom orders will not be shipped until payment is received in full.

2.8 Once your order has been placed, you will receive an email confirming the details of your order.

3. Cancellation and Returns

3.1 Cancellations:

You may cancel your order within 24 hours of purchase by contacting me at bettykayton@gmail.com. After this period, cancellation may not be possible if your order has already been prepared or shipped.

3.2 Returns:

3.2.1 Due to the nature of original artwork and custom-made pieces, returns are generally not accepted unless the item is damaged in transit or significantly different from the description provided.

3.2.2 If your item arrives damaged, please contact me within 7 days of delivery with photographs of the packaging and the item. I will work with you to arrange a refund. Refunds will only be processed once the item is returned. For damaged items, please provide proof of shipping costs to be eligible for a shipping refund.

3.3 Return Shipping:

Where a return is agreed upon, (excluding items referred to in Clause 3.2.2 above) you are responsible for safely packaging the item and covering return shipping costs.

4. Delivery and Shipping

4.1 Items will be shipped to the address provided at checkout. Please ensure your details are accurate, as we cannot be held responsible for items lost due to incorrect information.
4.2 Delivery times may vary depending on your location and shipping method selected. Estimated shipping times will be provided at checkout, but I cannot guarantee exact delivery dates.
4.3 I take care in packaging artwork securely. In the rare event of damage during shipping, please follow the steps outlined in the Returns section.
4.4 International buyers are responsible for any customs duties, taxes, or import fees applicable in their country, as well as shipping costs.

5. Intellectual Property

5.1 All content on this website, including but not limited to images of artworks, text, designs, and logos, are the property of Betty Kayton Art and are protected by copyright law.
5.2 Purchasing an artwork does not transfer the copyright or reproduction rights. The buyer owns only the physical item purchased, not the right to reproduce, distribute, or create derivative works from it.
5.3 No content from this site may be copied, reproduced, or used for commercial purposes without written permission from Betty Kayton Art.

6. Privacy & Data Use

6.1 I respect your privacy and am committed to protecting your personal information.
6.2 Information collected during the ordering process (such as your name, email, shipping address, and payment details) will only be used to process and deliver your order, and to communicate with you regarding your purchase.
6.3 I do not sell, trade, or share your personal information with third parties, except as required to complete transactions (e.g., payment processors, shipping companies).
6.4 Payment details are handled securely through trusted third-party payment providers and are never stored directly by me.
